Before placing an order, the customer must familiarise themselves with these Terms and Conditions. By placing an order, the customer confirms that they have had the opportunity to read the Terms and Conditions and agree to them.

Nothing in these Terms and Conditions limits any mandatory rights granted to consumers under applicable law.

Online Store Offer

The Petovar online store offers products from the Petovar range, including oils, spreads, pumpkin seeds and snacks, wheat flours, PET packaging and related products, as well as products from the gift range.

The product range may change. Each product page provides information relevant to the purchasing decision according to the nature of the product, such as the product name, description, price, net quantity or packaging, and other essential characteristics.

For food products, relevant information concerning ingredients, allergens, nutritional values, quantity and storage is provided on the individual product page and/or product packaging in accordance with applicable regulations.

Product photographs are intended to represent the products. Hand-decorated gift sets, wooden products and other products whose appearance may vary due to the production process or the natural characteristics of the materials may differ slightly from the photographs shown.

Such products may show minor variations in product arrangement, decorative details, wood tones and other non-essential characteristics that do not affect the intended use or essential characteristics of the product.

Personalised Products

For selected products from the gift range, customers may request personalisation by prior arrangement.

When ordering a personalised product, the customer must provide all information, text or instructions required for personalisation in a timely manner.

The customer is responsible for the accuracy of the information provided for personalisation. The provider is not responsible for errors resulting from incorrect or incomplete information supplied by the customer.

Special rules concerning the right of withdrawal may apply to personalised products, as described later in these Terms and Conditions.

Registration and Guest Checkout

Purchases from the Petovar online store can be made as a guest without registration or as a registered user.

Registration of a user account is not required to make a purchase.

When purchasing without registration, the customer provides the information necessary to process the order, complete the payment, arrange delivery or collection, and issue an invoice.

Registered users may use the user account features available in the online store at the relevant time.

Users are responsible for protecting their login details and for activities carried out through their user account. If a user suspects unauthorised use of their account, they must notify the provider as soon as possible.

The Petovar online store does not provide registration or login via Facebook or Google accounts.

Ordering Process

The customer selects the desired product, specifies the quantity and adds it to the shopping cart.

Before placing the order, the customer can review the selected products in the shopping cart, change quantities or remove products.

During the subsequent checkout process, the customer enters or confirms the information required to process the order and selects an available delivery method or personal collection and a payment method.

Before finally placing the order, the customer has the opportunity to review the essential order information, including the selected products, quantities, prices, delivery charges and total amount.

The customer can correct any input errors before finally submitting the order.

The order is placed when the customer performs the final action confirming the order, from which it is clear that the order entails an obligation to pay.

After successfully placing the order, the customer receives confirmation of receipt of the order at the email address provided.

Conclusion of the Sales Contract

The sales contract between the provider and the customer is concluded when the provider confirms the order.

From the moment the contract is concluded, the prices and other conditions applicable at the time the order was placed apply, unless the provider and the customer expressly agree otherwise.

If the provider is unable to fulfil the order due to product unavailability, an obvious pricing error, a technical error or another justified reason, the customer will be informed without undue delay.

If the customer has already paid for such an order and the contract is not concluded or the order cannot be fulfilled, the provider will refund the payment received.

The concluded contract and/or order information is stored electronically by the provider. The customer may request information about their order by email at info@petovar.com .

Prices

All prices in the online store are stated in euros (EUR) and include VAT unless expressly stated otherwise for an individual product.

The price applicable to an individual order is the price displayed at the time the order is placed.

Delivery charges and any other costs associated with the order are shown to the customer before the order is finally submitted.

The provider reserves the right to change prices and the product range for future orders.

If an incorrect price is displayed for a product due to an obvious technical, system or other error, the provider will inform the customer. The customer may confirm the order at the correct price or cancel the order.

If payment has already been made and the customer does not confirm the order at the correct price, the provider will refund the payment received.

Payment Methods

The following payment methods may be available in the Petovar online store:

  • payment by debit or credit card,

  • payment by pro forma invoice,

  • cash on delivery,

  • payment via PayPal.

The payment methods actually available for an individual order are displayed during the checkout process.

When paying by pro forma invoice, the customer receives the information required to make the payment at the email address provided. Processing of the order begins after payment has been received.

If payment of the pro forma invoice is not made within the period specified on the pro forma invoice or in the provider's notification, the provider may cancel the order.

When paying by debit or credit card or via PayPal, payment is processed through the relevant payment system.

For cash-on-delivery orders, the customer pays for the order in accordance with the options and conditions of the delivery service.

Any additional charges associated with the selected payment method are shown to the customer before the order is finally placed, where such charges apply.

Delivery

The provider normally dispatches orders that can be fulfilled and for which all conditions for processing have been met no later than within five business days, unless otherwise stated for an individual product or order.

The stated period is the dispatch period and does not include the delivery time required by the delivery service.

For orders delivered within Slovenia, the provider normally uses Pošta Slovenije.

For international deliveries, the provider normally uses Pošta Slovenije or DHL, depending on the destination country, shipment characteristics and available delivery options.

For organisational, logistical or other justified reasons, the provider may also use another suitable delivery service.

The availability of delivery to a particular country and the delivery cost are calculated according to the details of the individual order and are shown to the customer before the order is finally placed.

If an ordered product cannot be dispatched within the expected period, the provider will inform the customer.

Personal Collection

The customer may select personal collection when this option is available during the checkout process.

Personal collection is available at:

Petovar d.o.o.
Gradiška cesta 4
2230 Lenart
Slovenia

The customer will be notified when the order is ready for collection.

Receipt of the Shipment

The customer should inspect the condition of the shipment upon receipt.

If the packaging is visibly damaged or there is reason to believe that the goods were damaged during transport, we recommend that the customer, where possible, records the damage with the delivery service and informs the provider as soon as possible at info@petovar.com or 02 620 46 00.

This does not affect the customer's statutory rights in the event of non-conformity of the goods.

Invoice

The customer receives an invoice for the purchase in electronic and/or physical form depending on the method of purchase, payment and delivery.

The invoice shows the purchased products, their prices, taxes and other charges.

If the customer requires an invoice issued to a company, the customer must enter the correct company information required for issuing the invoice before finally placing the order.

Non-conformity of Goods

The provider is liable for non-conformity of goods in accordance with the provisions of the Slovenian Consumer Protection Act (ZVPot-1).

Goods are considered to conform to the sales contract when they correspond to the agreed description, type, quantity and quality and have the characteristics, functionality and other features agreed in the sales contract or which the consumer may reasonably expect considering the nature of the goods.

The provider is liable for any non-conformity that existed at the time of delivery and becomes apparent within two years from the delivery of the goods.

If the non-conformity becomes apparent within one year from the delivery of the goods, it is presumed to have existed at the time of delivery unless the provider proves otherwise or unless such a presumption is incompatible with the nature of the goods or the nature of the non-conformity.

The consumer must notify the provider of the non-conformity within two months from the date on which the non-conformity was discovered.

In the notice of non-conformity, the consumer must describe the non-conformity in detail and allow the provider to inspect the goods.

The consumer may notify the provider of non-conformity using the following contact details:

Email: info@petovar.com
Phone: 02 620 46 00
Address: Petovar d.o.o., Gradiška cesta 4, 2230 Lenart, Slovenia

In accordance with ZVPot-1 and subject to the conditions prescribed by law, the consumer may request that the goods be brought into conformity free of charge, request a proportionate reduction of the purchase price or withdraw from the sales contract.

As a general rule, the consumer must first request that the goods be brought into conformity, except where ZVPot-1 permits the immediate exercise of another remedy.

If the non-conformity of the goods becomes apparent within less than 30 days from delivery, the consumer may withdraw from the sales contract and request a refund of the amount paid in accordance with ZVPot-1.

If the provider disputes the existence of the non-conformity, the provider will notify the consumer in writing within the period prescribed by applicable law.

Complaints

If the customer receives an incorrect, incomplete or damaged product or has another complaint concerning an order, the customer may notify the provider.

Complaints may be submitted using the following contact details:

Email: info@petovar.com
Phone: 02 620 46 00

To enable faster processing, we recommend that the customer provides the order or invoice number, describes the issue and, where possible, attaches photographs of the product or damage.

The provider will endeavour to process complaints as quickly as possible and inform the customer of the further procedure.

The complaints procedure does not limit any statutory rights available to the consumer in the event of non-conformity of the goods.

Consumer's Right of Withdrawal

For a contract concluded at a distance, the consumer has the right to withdraw from the contract within 14 days without giving any reason.

This right applies to consumers, meaning natural persons who conclude a contract for purposes outside their trade, business, craft or professional activity.

For a sales contract, the 14-day withdrawal period generally begins on the day when:

  • the consumer or a third party designated by the consumer, other than the carrier, acquires physical possession of the goods;

  • the consumer acquires physical possession of the last item or shipment where the contract concerns several goods delivered separately;

  • the consumer acquires physical possession of the last item or part where delivery consists of several shipments or parts.

To exercise the right of withdrawal, the consumer must inform the provider of the decision to withdraw from the contract by an unequivocal statement before the withdrawal period expires.

The notice may be sent:

by email: info@petovar.com

or

by post:
Petovar d.o.o.
Gradiška cesta 4
2230 Lenart
Slovenia

The consumer may use the statutory model withdrawal form, but use of the form is not mandatory.

To meet the withdrawal deadline, it is sufficient for the consumer to send the notice of withdrawal before the 14-day withdrawal period has expired.

Return of Goods Following Withdrawal

If the consumer withdraws from the contract, the goods must be returned or handed over to the provider without undue delay and no later than 14 days from the date on which the consumer notified the provider of the withdrawal.

Goods must be returned to:

Petovar d.o.o.
Gradiška cesta 4
2230 Lenart
Slovenia

The return deadline is met if the consumer sends the goods before the 14-day period has expired.

The consumer normally bears the direct cost of returning the goods unless applicable law provides otherwise or the provider expressly agrees to bear those costs.

We recommend including the order number or a copy of the invoice with the return, as this allows the return to be identified and processed more quickly.

The goods must be adequately protected against damage during return transport.

The consumer is liable for any diminished value of the goods resulting from handling other than what is necessary to establish the nature, characteristics and functioning of the goods.

Refunds

If the consumer validly withdraws from the contract, the provider will refund the payments received from the consumer in accordance with applicable law, including the cost of standard delivery.

If the consumer selected a delivery method that is more expensive than the least expensive standard delivery method offered by the provider, the provider is not required to reimburse the additional cost of the more expensive delivery method.

The provider will make the refund without undue delay and no later than 14 days after receiving the consumer's notice of withdrawal.

The refund will normally be made using the same payment method used by the consumer for the original transaction, unless the provider and the consumer expressly agree otherwise and the consumer does not incur any additional costs as a result.

For sales contracts, the provider may withhold the refund until the returned goods have been received or until the consumer provides evidence that the goods have been sent back, unless the provider has offered to collect the goods.

Exceptions to the Right of Withdrawal

The right of withdrawal does not apply in cases specified by ZVPot-1.

Considering the products offered by the Petovar online store, the following exceptions may be particularly relevant:

  • goods made according to the consumer's precise instructions and adapted to the consumer's personal needs;

  • personalised gift products or other products made or adapted specifically for an individual customer;

  • goods which are liable to deteriorate or expire rapidly;

  • sealed goods which are not suitable for return due to health protection or hygiene reasons if the consumer has opened the seal after delivery;

  • other cases for which ZVPot-1 provides an exception to the right of withdrawal.

Where a customer orders a personalised gift product made or adapted according to the customer's precise instructions or personal requirements, the customer generally does not have the 14-day right of withdrawal for that product.

The fact that a product is a food product does not in itself automatically exclude the right of withdrawal. Whether the return of a particular food product is excluded depends on the nature of the specific product and the conditions prescribed by applicable law.

Complaints Handling

The provider complies with applicable consumer-protection legislation and aims to maintain an effective complaints-handling procedure.

Customers may submit complaints using the following contact details:

Email: info@petovar.com
Phone: 02 620 46 00

The provider will endeavour to process complaints as quickly as possible and, where necessary, keep the customer informed of the progress of the complaint.

The complaints procedure is confidential.

The provider and the customer will endeavour to resolve any disputes amicably.

If an amicable resolution cannot be reached, disputes will be resolved by the court having subject-matter and territorial jurisdiction in accordance with applicable law.

The provisions concerning jurisdiction do not affect any mandatory rights available to consumers under applicable legislation.

Out-of-Court Resolution of Consumer Disputes

In accordance with the Slovenian Out-of-Court Resolution of Consumer Disputes Act (ZIsRPS), Petovar d.o.o. does not recognise any provider of out-of-court consumer dispute resolution services as competent to resolve a consumer dispute that a consumer may initiate under ZIsRPS.

If the provider's position regarding recognition of an out-of-court consumer dispute resolution provider changes, the relevant information will be updated on the website.

Protection of Personal Data

The provider processes the personal data of users and customers in accordance with applicable data-protection legislation.

Detailed information regarding the categories of personal data processed, the purposes and legal bases for processing, retention periods, users' rights and other information concerning the processing of personal data is provided in the separate Privacy Policy published on the Petovar website.

Cookies

Information about the use of cookies and similar technologies on www.petovar.com is provided on the separate Cookies page.

On that page, users can find information about the types of cookies used, their purposes and the available options for managing consent.

Applicable Law

The business relationship between the provider and the customer is governed by the law of the Republic of Slovenia.

Where the customer is a consumer residing in another country, the choice of Slovenian law does not deprive the consumer of the protection afforded by mandatory provisions of the law that would apply in the absence of such a choice of law.

Amendments to the Terms and Conditions

The provider reserves the right to amend or supplement these Terms and Conditions due to changes in legislation, business processes, the online store's product range or other justified reasons.

Amended Terms and Conditions take effect on the date of publication or on another date specified in the amended Terms and Conditions.

Each individual order is governed by the Terms and Conditions that were published and accepted by the customer at the time the order was placed.

If any provision of these Terms and Conditions is found to be invalid or unenforceable, this does not affect the validity of the remaining provisions.
